OYLA respects intellectual property rights and expects its users to do the same. This page explains how to tell us about content that infringes your copyright, and what happens next. We follow the notice-and-takedown process of the U.S. Digital Millennium Copyright Act (17 U.S.C. ยง 512) and similar laws.
1. Reporting infringement
Send a notice to support@oylavote.com with the subject "Copyright notice". To be valid, it must include:
- your physical or electronic signature (typing your full name is enough);
- the copyrighted work you say is infringed, or a representative list if there are several;
- the content you want removed and where it is: a link to the poll, or its title and the account that posted it, and which image or text is concerned;
- your name, postal address, phone number and email address;
- a statement that you believe in good faith that the use is not authorised by the copyright owner, its agent or the law;
- a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorised to act for the owner.
Please consider whether the use may be permitted (for example as fair use) before sending a notice. Knowingly making a false claim can make you liable for damages.
2. What we do
When we receive a valid notice we remove or disable the content promptly, tell the user who posted it, and give them a copy of the notice.
3. Counter-notice
If your content was removed and you believe that was a mistake or a misidentification, reply to support@oylavote.com with the subject "Copyright counter-notice" and include:
- your physical or electronic signature;
- the content that was removed and where it appeared before removal;
- a statement, under penalty of perjury, that you believe in good faith the content was removed by mistake or misidentification;
- your name, postal address and phone number;
- a statement that you consent to the jurisdiction of the federal district court for the district where you live, or, if you live outside the United States, of any judicial district in which OYLA may be found, and that you will accept service of process from the person who sent the original notice.
We forward a valid counter-notice to the person who complained. We may restore the content 10 to 14 business days later unless they tell us they have filed a court action about it.
4. Repeat infringers
We terminate, in appropriate circumstances, the accounts of users who repeatedly infringe.
5. Trademarks and other rights
For trademark, impersonation or privacy complaints, use the in-app report tools or email support@oylavote.com.
